Terms of Service

These Terms of Service ("Terms") govern your access to and use of pixl (the "Service"), a desktop software product offered by pixl ("we", "us", "our"). By purchasing, downloading, installing, or using the Service, you agree to be bound by these Terms.

1. Description of Service

pixl is desktop task automation software designed to help users configure profiles, manage proxy lists, and execute multi-step tasks with real-time status tracking. The Service is available for Windows and macOS.

2. License Grant (Not a Sale)

You are purchasing a revocable, non-exclusive, non-transferable license to use the Service. You do not acquire any ownership rights in the software. This is a license, not a sale, in accordance with California AB 2426.

3. License Restrictions

You agree not to:

  • Resell, sublicense, share, or transfer your license to any third party
  • Reverse engineer, decompile, disassemble, or attempt to derive source code
  • Circumvent, disable, or interfere with security or licensing mechanisms
  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Use the Service to violate the rights of any third party

4. Device Limitations

Each license permits use on one active device at a time. You may transfer your license to a different device, subject to a cooldown period. Attempting to circumvent device limits may result in suspension or termination of your license.

5. Account and Authentication

Access to the Service requires authentication via Discord OAuth. You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted under your account. Your license is permanently tied to your Discord account and cannot be transferred.

6. Pricing and Payment

Prices are displayed on our website and are subject to change. Payments are processed by Stripe. You authorize us (and Stripe as our payment processor) to charge your payment method for purchases and renewals. You are responsible for any applicable taxes.

7. Free Trial

Subscription plans include a 7-day free trial. A valid payment method is required to start the trial. Unless you cancel before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged at the end of the trial period at the rate of your selected plan.

8. Subscription Renewal (Auto-Renewal Disclosure)

Subscriptions renew automatically at the end of each billing period (monthly, quarterly, or annually) unless cancelled. The renewal charge will be the same as your initial subscription price unless we notify you of a price change in advance. You can cancel at any time; cancellation takes effect at the end of the current billing period.

9. Cancellation

To cancel your subscription, use the Stripe Customer Portal (accessible from your account) or contact support at support@pixlai.one. Cancellation will be effective at the end of your current billing period. You will retain access until then.

10. Digital Delivery

The Service is delivered digitally. After successful payment, access is granted immediately via license activation. If you experience any issues with delivery, contact support promptly and we will work to resolve the issue.

11. Refund Policy

All sales are final. No refunds. The free trial is provided so you can evaluate the Service before billing begins. If you believe you were charged in error, contact support within 48 hours of the charge.

12. Termination

We may suspend or terminate your access to the Service if you violate these Terms, engage in fraudulent activity, or if required to comply with law. Upon termination, your license ends immediately and you must cease all use of the Service.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR SPECIFIC REQUIREMENTS. USE OF THE SERVICE IS AT YOUR OWN RISK.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, pixl WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

15. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of laws principles. Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in California.

16. Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration administered by JAMS in accordance with its Streamlined Arbitration Rules. The arbitration shall take place in California. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and pixl regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.

19. Changes to Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
